CAFFEINE ARMY LLC (“Caffeine Army®,” “Company” or “we”) provides you access to and use of the Service (as defined below) subject to these SUBSCRIPTION Terms and Conditions (the “Subscription Service”).

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE WEB SITE LOCATED AT CAFFEINEARMY.COM AND ALL ASSOCIATED WEB SITES LINKED TO CAFFEINEARMY.COM (COLLECTIVELY, THE "SITE"), MOBILE SOFTWARE AND/OR SERVICES (COLLECTIVELY, THE “SERVICE”) TO PURCHASE ANY PRODUCT(S). YOUR USE OF THE SERVICE CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE OF THE FOLLOWING TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE SERVICE.

ACKNOWLEDGEMENT

By accessing or using the Membership Service, you agree to abide by these Terms, as they may be amended by Company from time to time in its sole discretion, and that such agreement constitutes a binding contract between you and Company. In addition, when visiting or using certain Company owned or operated web sites, you shall be subject to any posted agreements, guidelines, rules or terms of service. All such agreements, guidelines, rules or terms of service, as they may be amended by Company from time to time in its sole discretion, are hereby incorporated by reference into these Terms. It is your responsibility to review these Terms periodically, and if you do not have the authority to agree or accept these Terms, or if at any time you find these Terms unacceptable, you may not use the Service and you must immediately leave and cease all use of the Service.

MEMBERSHIP SERVICE DESCRIPTION & RULES

Aiming to bring comfort to its customers, Caffeine Army® establishes the subscription format, with monthly payment and delivery recurrence, through the membership program, regulated by the following terms:

• The MEMBER is entirely responsible for correctly providing their registration and payment details.

• The MEMBER is also responsible for verifying, correcting, and updating their information in case of any change, 3 days before the placement of a new order.

• The MEMBER'S password is for personal and non-transferable use. The MEMBER is solely responsible for any sharing or improper use by third parties. Please be aware that such actions may compromise the security of the account. The MEMBER  has the option to change its password at any time.

• The use of our website, registration, and subscription presupposes the acceptance of our Privacy Policy, which is available on our website, https://www.caffeinearmy.com/privacy-policy, as well as the acceptance of receiving communications via email, WhatsApp, and SMS.

PAYMENT

The MEMBER may change its payment information through the website or by contacting us at support@caffeinearmy.com.

Changes must be made at least 3 (three) days before the next billing date. If the change is made after this deadline, the change will only be valid from the next delivery.

DELIVERY INFORMATION

The product will be shipped within 3 (three) to 7 (seven) business days after payment confirmation.

Delivery time varies according to the chosen destination and is calculated automatically at the time of each charge. The deadline starts counting from the first business day after the financial institution confirms payment. The tracking code will be sent to the registered email as soon as the product is shipped.

SHIPPING COVERAGE

The MEMBERSHIP serves most addresses within the United States territory, based on the third-party carrier's logistics availability.

DELIVERY FAILURE

The product(s) will be delivered to the address provided by the MEMBER. The MEMBER is responsible for receiving the merchandise, exempting Caffeine Army® from any liability, including loss or misplacement of the duly delivered merchandise.

In cases of data inconsistency, refusal to receive the product, or no one receiving the product, up to three (3) delivery attempts will be made. If it is not possible to complete the delivery, the product will be automatically returned to the Caffeine Army®. In this case, Caffeine Army® will have to initiate a new shipping procedure. A new deadline will be announced from the date of dispatch from the distribution center, and the MEMBER will be responsible for the shipping costs.

If delivery is not possible, the product might be available at a post office, and it is up to the MEMBER to collect it within the due period.

If the product has not been proven to have been delivered or has been lost, the MEMBER is guaranteed the right to request, through the Caffeine Army®’s communication channels, that a new product be sent.

The MEMBER must submit non-receipt reports within 30 (thirty) days from the "Delivered" status date. The carrier has up to 5 (five) business days to prove delivery to the MEMBER. If this is not proven, Caffeine Army® will resend the product(s) to the MEMBER at no additional cost.

CHANGE OF ADDRESS

The MEMBER may change the address in their account up to 3 (three) days before the next charge date, with the request being subject to approval per MEMBERSHIP rules and logistics availability. Changes made after this deadline will be valid for the next delivery.

CANCELLATION

The MEMBER may cancel their MEMBERSHIP SERVICE up to 7 (seven) days before the next charge date, with the request being subject to approval per MEMBERSHIP rules and logistics availability. Changes made after this deadline will be valid for the next delivery.

RETURNS

Since the Membership Service can be customized monthly, the exchange or return of products already delivered is not allowed, except in cases where the product is defective or damaged, for which Caffeine Army® is responsible.

In the event of a defect or damage, the MEMBER has 30 (thirty) days from the proof of delivery date to return or exchange the product. Personal impressions about the product or reactions resulting from possible sensitivity to the product's components will not be considered defects or damage.

The “30-day Guarantee” does not apply to subscriptions.

CANCELLATION POLICY

Caffeine Army® offers different membership formats, including standard recurring memberships and 6-Month commitment memberships. The rules below apply according to the plan selected by the member at checkout.

1. Standard membership 

The member may cancel their membership at any time by cancelling through their membership portal or by submitting a cancellation request at least 3 (three) days before the next charge date.

Requests and automatic cancellations made less than 3 days prior to the billing cycle will apply to the following cycle.

2. 6-Month Commitment membership (Minimum Term Plan)

Caffeine Army® offers membership plans with delivery frequencies of 15, 30, 45, or 60 days under a 6-Month Commitment option.
When subscribing to a 6-Month Commitment plan:

a) The member agrees to maintain the membership active for 6 consecutive months.

This minimum term enables us to provide special pricing that is not available in flexible plans.

b) During the 6-month commitment period, cancellation is not permitted.

The membership must remain active until the completion of the minimum period.

3. Early Cancellation of a 6-Month Commitment (Optional Fee-Based Provision)

If Caffeine Army® chooses, at its sole discretion, to allow an early cancellation as an exception, an Early Termination Fee may apply.

The Early Termination Fee is intended to recover the discounts and benefits granted during the commitment period.

Early Termination Fee Structure:

If early cancellation is approved, the member  may be charged a flat fee, which is calculated as follows: 

Fee = (months remaining)×(discount or credit per month)

Example: If the customer saved $5 per delivery for a 6-month commitment and cancels with 4 months left:

4×$5 = $20 early termination fee (4 times \$5 = \$20)

This fee will be communicated at the time the client requests the membership cancellation. When the client subscribes to the membership they are already agreeing with this condition.

4. End of the Commitment Period

After completing the 6-month commitment, the membership becomes flexible and may be cancelled at any time by following the cancellation guidelines described above.

COMMITMENT TO TRANSPARENCY

Caffeine Army® is committed to providing a clear, fair, and transparent membership experience. All membership details, including commitment terms, pricing, and cancellation rules, are displayed to the member in this document.

Membership Journey & Rewards Policy

New members enrolling in the Membership Program, from 22/01/2026 at 12:00pm EST, may receive promotional gifts with their first subscription order. Gift eligibility is determined by the subtotal value of the first order, in accordance with the following tiers:

• Orders over $0: Brochure, Sticker, and Calendar

• Orders over $35: 1 Sample Pack

• Orders over $55: 1 Frother + Rewards Card

• Orders over $75: 1 Sample Pack

• Orders over $105: 1 Sample Pack

The promotional items displayed in marketing materials represent all gifts available within the fist shipment for the program. Not all gifts are included with every order, and items are awarded strictly based on the applicable order value tier.

In addition to the first-order gifts, members may receive additional experiences, or promotional items throughout the duration of their subscription, as part of the Membership Program journey.

These additional gifts or experiences do not require prior communication or announcement and will be sent exclusively to members who meet the eligibility criteria at the time of fulfillment. 

Caffeine Army® reserves the right to modify, substitute, or discontinue promotional items or experiences at any time, without prior notice, while maintaining the overall intent of the Membership Program.

Eligibility:

This promotional gift journey is exclusively available to new members enrolling in the Membership Program for the first time. Existing members, reactivations, or plan changes do not qualify for new-member promotional gifts unless explicitly stated otherwise.

Promotional gifts are non-transferable, non-refundable, and not redeemable for cash or credit.

Affiliate rule: 

If the customer wants the affiliate to earn a commission when subscribing, the membership must be made through the purchase link provided by the affiliate.
